{"id":8319,"date":"2025-11-13T06:46:05","date_gmt":"2025-11-13T06:46:05","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8319"},"modified":"2025-11-15T09:41:56","modified_gmt":"2025-11-15T09:41:56","slug":"unberechtigte-nutzung-von-sportfotos","status":"publish","type":"post","link":"https:\/\/www.johanna-swist.de\/wpjs\/de\/unberechtigte-nutzung-von-sportfotos\/","title":{"rendered":"Bildrecht: unberechtigte Nutzung von Sportfotos, Amtsgericht D\u00fcsseldorf, 57 C 4889\/10, vom 06.10.2010"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Unberechtigte Nutzung von Sportfotos<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine etwas \u00e4ltere Entscheidung des Amtsgericht D\u00fcsseldorf <\/span><span style=\"color: #080060;\"><strong>(AG D\u00fcsseldorf, 57 C 4889\/10, vom 06.10.2010)<\/strong><\/span><span style=\"color: #000000;\"> in Zusammenhang mit der <\/span><span style=\"color: #000000;\">unberechtigte Nutzung von Sportfotos vor.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Unberechtigte Nutzung von Sportfotos\u00a0<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Kl\u00e4ger, ein akkreditierter Hobbyfotograf der Beklagten zu 2) (einem Fu\u00dfballverein), \u00fcbergab dem Verein eine CD mit Fotos zur <b>unentgeltlichen<\/b> Verwendung im <b>Fanmagazin<\/b>. Der Pressesprecher des Vereins (Zeuge F) gab eines dieser Fotos an die Beklagte zu 1) (ein werbendes Unternehmen) weiter, die es in einer <b>Printanzeige<\/b> nutzte, wobei der Urheber falsch genannt wurde. Der Kl\u00e4ger forderte von beiden Beklagten Schadensersatz (fiktive Lizenzentsch\u00e4digung) und die Abmahnkosten.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Haftungsgrundlage: Urheberrechtsverletzung (\u00a7 97 Abs. 1 UrhG)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht bejahte eine <b>Urheberrechtsverletzung<\/b> durch beide Beklagte.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Rechte des Kl\u00e4gers:<\/b> <\/span>Der Kl\u00e4ger verlor seine Rechte nicht, weil er als &#8222;Hobbyfotograf&#8220; t\u00e4tig war. Ma\u00dfgeblich ist die <b><span style=\"color: #0d0063;\">Qualit\u00e4t des<\/span> <span style=\"color: #0d0063;\">Fotos<\/span><\/b><span style=\"color: #0d0063;\">,<\/span> die hier als gut eingestuft wurde.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Haftung des Vereins (Beklagte zu 2):<\/b> <\/span>Der Verein durfte das Foto an Dritte (Beklagte zu 1)<span style=\"color: #0d0063;\"> <b>nicht<\/b> <\/span>weitergeben.<\/span>\n<ul>\n<li><span style=\"color: #000000;\"><b><span style=\"color: #0d0063;\">Zweck\u00fcbertragungslehre (\u00a7 31 Abs. 5 UrhG)<\/span>:<\/b> Bei der unentgeltlichen \u00dcberlassung der CD wurde dem Verein im Zweifel <span style=\"color: #0d0063;\"><b>nur das Nutzungsrecht<\/b><\/span> einger\u00e4umt, das zur Erreichung des Vertragszwecks (Ver\u00f6ffentlichung im <span style=\"color: #0d0063;\"><b>Fanmagazin<\/b><\/span>) erforderlich war.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Kein ausschlie\u00dfliches Nutzungsrecht:<\/b><\/span> Da die Parteien \u00fcber eine <span style=\"color: #0d0063;\"><b>nicht-kommerzielle Nutzung<\/b><\/span> im Magazin gesprochen hatten, kann nicht angenommen werden, dass der Kl\u00e4ger dem Verein die ausschlie\u00dflichen Rechte f\u00fcr eine <b><span style=\"color: #0d0063;\">gewerbliche<\/span> <span style=\"color: #0d0063;\">Werbeanzeige<\/span><\/b> einr\u00e4umen wollte. Die Weitergabe war daher rechtswidrig.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Haftung des Werbeunternehmens (Beklagte zu 1):<\/b><\/span> Das Unternehmen handelte <span style=\"color: #0d0063;\"><b>fahrl\u00e4ssig<\/b><\/span> bei der Verwendung des Fotos.<\/span>\n<ul>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Hohe Pr\u00fcfungspflicht:<\/b><\/span> Grunds\u00e4tzlich muss jeder gewerbliche Nutzer die Erlaubnis des wahren Berechtigten einholen. Da die Beklagte zu 1) wusste, dass der Verein <b>nicht<\/b> der Urheber war, traf sie eine <span style=\"color: #0d0063;\"><b>besonders hohe Sorgfaltsanforderung<\/b>.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Kein Vertrauen auf &#8222;rechtefrei&#8220;:<\/b><\/span> Das Unternehmen durfte sich nicht ohne Weiteres auf die (falsche) Angabe des Pressesprechers F verlassen, das Foto sei &#8222;rechtefrei&#8220;. Die Verwendung war widerrechtlich.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Schadensersatz: H\u00f6he der Lizenzentsch\u00e4digung (Schadensersatz nach \u00a7 97 Abs. 2 UrhG)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Schaden wurde im Wege der <span style=\"color: #0d0063;\"><b>fiktiven Lizenzanalogie<\/b><\/span> berechnet. Das Gericht sprach dem Kl\u00e4ger insgesamt <span style=\"color: #0d0063;\"><b>375,00 \u20ac<\/b><\/span> gegen die Beklagte zu 1) zu.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Ma\u00dfstab der Berechnung:<\/b> <\/span>Als geeignete Grundlage zur Sch\u00e4tzung (\u00a7 287 ZPO) wurden die <span style=\"color: #0d0063;\"><b>Preisliste der MFM<\/b><\/span> (Mittelstandsgemeinschaft Fotomarketing) herangezogen. Die Tarife der VG Bild-Kunst galten nicht, da das Gericht das Foto als einfaches <span style=\"color: #0d0063;\"><b>Lichtbild<\/b> <\/span>(\u00a7 72 UrhG) und nicht als<span style=\"color: #0d0063;\"><strong> Lichtbildwerk<\/strong><\/span> einstufte.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Basiswert:<\/b><\/span> Das Gericht ordnete das Foto gem\u00e4\u00df MFM-Tabelle in die Kategorie <span style=\"color: #0d0063;\"><b>1\/8 Seite<\/b><\/span> bei einer Auflage von bis zu 100.000 ein (Basis: <span style=\"color: #0d0063;\"><b>375,00 \u20ac<\/b><\/span>).<\/span><\/li>\n<li><span style=\"color: #000000;\"><b><span style=\"color: #0d0063;\">Abschlag (Zweitverwertung)<\/span>:<\/b> Da das Foto dem Verein bereits fertig und unentgeltlich zur Verf\u00fcgung stand, bewertete das Gericht die gewerbliche Nutzung als<span style=\"color: #0d0063;\"> <b>Zweitverwertung<\/b><\/span> und zog einen <span style=\"color: #0d0063;\"><b>Abschlag von 50 %<\/b><\/span> ab (375,00 \u20ac \/ 2 = 187,50 \u20ac).<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><b>Zuschlag (Fehlende Urhebernennung):<\/b><\/span> Wegen der <span style=\"color: #0d0063;\"><b>falschen Urheberbezeichnung<\/b><\/span> (Verletzung des Rechts auf Namensnennung, \u00a7 13 UrhG) verlangte der Kl\u00e4ger zu Recht einen <span style=\"color: #0d0063;\"><b>100 %igen Zuschlag<\/b><\/span> auf den geminderten Betrag.<\/span><\/li>\n<\/ul>\n<p class=\"math-block\" style=\"text-align: center;\" data-math=\"\\text{Schaden} = (\\text{Basiswert} \\times 50 \\%) + (\\text{Basiswert} \\times 50 \\% \\times 100 \\%) = 187,50 \u20ac + 187,50 \u20ac = 375,00 \u20ac\"><span style=\"color: #0d0063;\"><strong><span class=\"katex-display\"><span class=\"katex\"><span class=\"katex-html\" aria-hidden=\"true\"><span class=\"base\"><span class=\"mord text\"><span class=\"mord\">Schaden<\/span><\/span><span class=\"mrel\">=<\/span><\/span><span class=\"base\"><span class=\"mopen\">(<\/span><span class=\"mord text\"><span class=\"mord\">Basiswert<\/span><\/span><span class=\"mbin\">\u00d7<\/span><\/span><span class=\"base\"><span class=\"mord\">50%<\/span><span class=\"mclose\">)<\/span><span class=\"mbin\">+<\/span><\/span><span class=\"base\"><span class=\"mopen\">(<\/span><span class=\"mord text\"><span class=\"mord\">Basiswert<\/span><\/span><span class=\"mbin\">\u00d7<\/span><\/span><span class=\"base\"><span class=\"mord\">50%<\/span><span class=\"mbin\">\u00d7<\/span><\/span><span class=\"base\"><span class=\"mord\">100%<\/span><span class=\"mclose\">)<\/span><span class=\"mrel\">=<\/span><\/span><span class=\"base\"><span class=\"mord\">187<\/span><span class=\"mpunct\">,<\/span><span class=\"mord\">50\u20ac<\/span><span class=\"mbin\">+<\/span><\/span><span class=\"base\"><span class=\"mord\">187<\/span><span class=\"mpunct\">,<\/span><span class=\"mord\">50\u20ac<\/span><span class=\"mrel\">=<\/span><\/span><span class=\"base\"><span class=\"mord\">375<\/span><span class=\"mpunct\">,<\/span><span class=\"mord\">00\u20ac<\/span><\/span><\/span><\/span><\/span><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Abmahnkosten<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Beide Beklagte wurden zur Zahlung der Abmahnkosten verurteilt, da die Abmahnung gegen beide zu Recht erfolgte.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><b><span style=\"color: #0d0063;\">Beklagte zu 1 (Werbeunternehmen)<\/span>:<\/b> 603,93 \u20ac (basierend auf einem Gegenstandswert von 6.600,00 \u20ac).<\/span><\/li>\n<li><span style=\"color: #000000;\"><b><span style=\"color: #0d0063;\">Beklagte zu 2 (Verein)<\/span>:<\/b> 546,69 \u20ac (basierend auf einem Gegenstandswert von 5.100,00 \u20ac).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die zentrale juristische Erw\u00e4gung ist die Anwendung der <span style=\"color: #0d0063;\"><b>Zweck\u00fcbertragungslehre<\/b><\/span> zur Begrenzung der Nutzungsrechte des Vereins.
