{"id":8315,"date":"2025-11-15T12:32:15","date_gmt":"2025-11-15T12:32:15","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8315"},"modified":"2025-11-22T12:11:48","modified_gmt":"2025-11-22T12:11:48","slug":"bildrecht-fotos-eines-kalbs","status":"publish","type":"post","link":"https:\/\/www.johanna-swist.de\/wpjs\/de\/bildrecht-fotos-eines-kalbs\/","title":{"rendered":"Bildrecht: Fotos eines Kalbes, Amtsgericht K\u00f6ln, 111 C 33\/10, vom 22.06.2010"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\"> Fotos eines Kalbes<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine etwas \u00e4ltere Entscheidung des Amtsgericht K\u00f6ln <span style=\"color: #080060;\"><strong>(AG K\u00f6ln, 115 C 100\/19, vom 30.01.2020)<\/strong><\/span> in Zusammenhang mit m\u00f6glichen Anspr\u00fcchen bei einem Foto eines fremden Kalbes.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Fotos eines Kalbs<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die Kl\u00e4gerin, eine B\u00e4uerin, hielt das Kalb &#8222;Anita&#8220;. Die Beklagte, eine Event-Veranstalterin, nutzte Fotos dieses Kalbes auf ihrer Website zur Bewerbung einer &#8222;Kuh-Charity-Party&#8220;. Die Kl\u00e4gerin behauptete, die Fotos seien ohne ihre Erlaubnis gefertigt und gewerblich genutzt worden. Sie forderte <span style=\"color: #080060;\"><b>2.000,00 \u20ac Schadensersatz<\/b><\/span> (als fiktive Geb\u00fchr f\u00fcr gewerbliche Fotonutzung) und Freistellung von vorgerichtlichen Anwaltskosten.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Begr\u00fcndetheit der Klage (Hauptforderung abgewiesen)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht wies die Klage auf Zahlung von 2.000,00 \u20ac Schadensersatz sowie die Nebenforderungen (Anwaltskosten, Zinsen) vollst\u00e4ndig ab. Die Kl\u00e4gerin hatte <span style=\"color: #080060;\"><b>keinen Anspruch<\/b><\/span> unter den geltend gemachten rechtlichen Gesichtspunkten.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Kein Schadensersatzanspruch aus Eigentumsverletzung (<a style=\"color: #0d0063;\" href=\"https:\/\/dejure.org\/gesetze\/BGB\/823.html\">\u00a7 823 Abs. 1 BGB<\/a>)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht verneinte eine Verletzung des Eigentums der Kl\u00e4gerin am Kalb (\u00a7 903 BGB).<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Fotografieren verletzt nicht das Eigentum:<\/b><\/span> Weder die Fertigung der Fotos noch deren Verbreitung stellt eine Eigentumsverletzung dar.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Keine Einwirkung auf die Sache:<\/b><\/span> Das Fotografieren selbst f\u00fchrt zu <span style=\"color: #080060;\"><b>keiner Substanzverletzung<\/b><\/span> des Kalbes und ist auch <span style=\"color: #080060;\"><b>keine tats\u00e4chliche Einwirkung<\/b><\/span> auf die Sache.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 80px;\"><em><span style=\"color: #000000;\">&#8222;Der Fotografiervorgang l\u00e4sst als Realakt die Verf\u00fcgungsbefugnis des Eigent\u00fcmers unber\u00fchrt. Er hindert den Eigent\u00fcmer nicht daran, mit der Sache nach Belieben zu verfahren und st\u00f6rt ihn auch nicht in seinem Besitz.&#8220;(Rn. 28)<\/span><\/em><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Kein Schadensersatzanspruch aus Verletzung des Allgemeinen Pers\u00f6nlichkeitsrechts (<a style=\"color: #0d0063;\" href=\"https:\/\/dejure.org\/gesetze\/BGB\/823.html\">\u00a7 823 Abs. 1 BGB<\/a>)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Eingriff in das Allgemeine Pers\u00f6nlichkeitsrecht der Kl\u00e4gerin wurde ebenfalls verneint.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Erforderlicher Bezug zur menschlichen Pers\u00f6nlichkeit fehlt:<\/b> <\/span>Zwar kann die unzul\u00e4ssige Verbreitung von Fotos das Pers\u00f6nlichkeitsrecht verletzen, dies erfordert aber stets einen <span style=\"color: #080060;\"><b>Bezug zur menschlichen Pers\u00f6nlichkeit<\/b>.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Kalb liefert keine R\u00fcckschl\u00fcsse:<\/b><\/span> Das Gericht argumentierte, dass anders als bei Fotos von H\u00e4usern oder Wohnungen, deren Gestaltung R\u00fcckschl\u00fcsse auf den Lebensstil der Eigent\u00fcmer zul\u00e4sst, Fotos eines<span style=\"color: #080060;\"> <b>Rinderkalbes keine R\u00fcckschl\u00fcsse auf die Pers\u00f6nlichkeit der B\u00e4uerin<\/b> <\/span>zulassen.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Kein Bereicherungsanspruch (\u00a7<a style=\"color: #0d0063;\" href=\"https:\/\/dejure.org\/gesetze\/BGB\/812.html\"> 812 Abs. 1 BGB<\/a> \u2013 Eingriffskondiktion)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Bereicherungsanspruch (Eingriffskondiktion) wurde verneint.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Fehlendes zugewiesenes Recht:<\/b><\/span> Die Eingriffskondiktion setzt voraus, dass in ein der Kl\u00e4gerin <span style=\"color: #080060;\"><b>zugewiesenes Recht<\/b><\/span> eingegriffen wurde. Da das Gericht bereits das Eigentum und das Pers\u00f6nlichkeitsrecht als nicht verletzt ansah, fehlt es an einem solchen Recht.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Kein Anspruch aus Gesch\u00e4ftsf\u00fchrung ohne Auftrag (GoA)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Anspruch aus GoA (\u00a7\u00a7<a style=\"color: #000000;\" href=\"https:\/\/dejure.org\/gesetze\/BGB\/687.html\"> 687 Abs. 2<\/a>, 681, 667 BGB) wurde verneint.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Kein fremdes Gesch\u00e4ft:<\/b><\/span> Da die Nutzung des Kalbes f\u00fcr Fotos und deren Verwertung <span style=\"color: #080060;\"><b>nicht dem Rechtskreis der Kl\u00e4gerin<\/b><\/span> zuzuordnen ist (siehe oben), hat die Beklagte kein fremdes Gesch\u00e4ft gef\u00fchrt.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Erledigungserkl\u00e4rung (Kostenentscheidung)<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Obwohl der urspr\u00fcngliche Antrag auf Entfernung der Fotos durch die Abschaltung der Website \u00fcbereinstimmend f\u00fcr <span style=\"color: #080060;\"><b>erledigt<\/b><\/span> erkl\u00e4rt wurde, wurden der Kl\u00e4gerin auch die darauf entfallenden Kosten nach <a href=\"https:\/\/dejure.org\/gesetze\/ZPO\/91a.html\"><span style=\"color: #080060;\"><b>\u00a7 91a ZPO<\/b><\/span><\/a> auferlegt.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Billigkeit der Kostenlast:<\/b><\/span> Dies entsprach der Billigkeit, weil die Kl\u00e4gerin nach Auffassung des Gerichts <span style=\"color: #080060;\"><b>auch insoweit unterlegen<\/b><\/span> gewesen w\u00e4re (Grund: Es mangelte auch hier an einer Eigentumsverletzung als Anspruchsgrundlage).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0d0063;\"><b>Fazit der juristischen Erw\u00e4gungen:<\/b> <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil best\u00e4tigt die rechtliche Position, dass das <span style=\"color: #080060;\"><b>Fotografieren von Sachen<\/b> <\/span>(hier ein Kalb) und die <span style=\"color: #080060;\"><b>gewerbliche Nutzung dieser Fotos<\/b><\/span> grunds\u00e4tzlich <span style=\"color: #080060;\"><b>keine Verletzung des Eigentums<\/b> <\/span>am abgebildeten Gegenstand darstellen.
