{"id":8313,"date":"2025-11-07T22:38:27","date_gmt":"2025-11-07T22:38:27","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8313"},"modified":"2025-11-09T13:23:46","modified_gmt":"2025-11-09T13:23:46","slug":"unberechtigte-nutzung-von-ebay-verkaufsanzeigen","status":"publish","type":"post","link":"https:\/\/www.johanna-swist.de\/wpjs\/de\/unberechtigte-nutzung-von-ebay-verkaufsanzeigen\/","title":{"rendered":"Bildrecht: unberechtigte Nutzung von eBay-Verkaufsanzeigen, Amtsgericht D\u00fcsseldorf, 57 C 9057\/13, vom 05.05.2014"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Urheberrechtsverletzung bei eBay\u00a0<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine etwas \u00e4ltere Entscheidung des Amtsgericht D\u00fcsseldorf <\/span><span style=\"color: #080060;\"><strong>(AG D\u00fcsseldorf, 57 C 9057\/13, vom 05.05,2014)<\/strong><\/span><span style=\"color: #000000;\"> in Zusammenhang mit der <\/span><span style=\"color: #000000;\">unberechtigte Nutzung von eBay-Verkaufsanzeigen.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: unberechtigte Nutzung von eBay-Verkaufsanzeigen!<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Beklagte nutzte in zwei seiner<span style=\"color: #080060;\"> <b>eBay-Verkaufsanzeigen<\/b><\/span> (November 2010) <span style=\"color: #080060;\"><b>zwei M\u00fcnzfotos<\/b><\/span> ohne Berechtigung. Der Kl\u00e4ger besa\u00df die ausschlie\u00dflichen Nutzungsrechte an diesen Fotos, die von einem professionellen Fotografen (Zeuge I) gefertigt wurden. Der Kl\u00e4ger forderte Schadensersatz f\u00fcr die unberechtigte Nutzung.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">War das Amtsgericht D\u00fcsseldorf zust\u00e4ndig?<\/span><\/h3>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Gerichtsstand:<\/b><\/span> Das Amtsgericht D\u00fcsseldorf erkl\u00e4rte sich als <span style=\"color: #080060;\"><b>Urhebergericht<\/b><\/span> gem\u00e4\u00df <a href=\"https:\/\/www.gesetze-im-internet.de\/zpo\/__32.html\">\u00a7 32 ZPO<\/a> f\u00fcr zust\u00e4ndig.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Begr\u00fcndung:<\/b><\/span> Da die Internetseite <span style=\"color: #080060;\"><b>eBay<\/b><\/span> im Gerichtsbezirk D\u00fcsseldorf aufrufbar ist, konnte der <span style=\"color: #080060;\"><b>Erfolg der Urheberverletzung<\/b> <\/span>(die unberechtigte Zug\u00e4nglichmachung des Fotos) auch in diesem Gerichtsbezirk eintreten.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Hat der Kl\u00e4ger einen Schadensersatzanspruch nach<a style=\"color: #0d0063;\" href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__97.html\"> \u00a7 97 Abs. 2 UrhG<\/a>?<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht bejahte den Anspruch des Kl\u00e4gers auf Schadensersatz wegen unberechtigter Nutzung.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Urheberrechtsschutz:<\/b><\/span> Die M\u00fcnzfotos sind als <span style=\"color: #080060;\"><b>Lichtbilder<\/b><\/span> gem\u00e4\u00df <a href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__72.html\"><span style=\"color: #080060;\"><b>\u00a7 72 Abs. 1 UrhG<\/b><\/span><\/a> urheberrechtlich gesch\u00fctzt. Der Schutz umfasst dabei auch Fotos von Gegenst\u00e4nden oder Produkten, die reinen Informationscharakter haben (sogenannte &#8222;kleine M\u00fcnze&#8220;).<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Nachweis der Rechtsinhaberschaft:<\/b><\/span> Der Kl\u00e4ger war Inhaber der ausschlie\u00dflichen Nutzungsrechte, da der Fotograf I die Rechte an ihn abgetreten hatte. Der Zeuge I best\u00e4tigte die<span style=\"color: #080060;\"> <b>Abtretungserkl\u00e4rungen<\/b><\/span> in seiner Vernehmung ausdr\u00fccklich.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Nachweis der Nutzung:<\/b><\/span> Das Gericht hielt die Nutzung der Fotos des Fotografen I durch den Beklagten f\u00fcr <span style=\"color: #080060;\"><b>nachgewiesen<\/b>.<\/span><\/span>\n<ul>\n<li><span style=\"color: #000000;\">Der Fotograf I erkannte seine Originalfotos anhand <span style=\"color: #080060;\"><b>markanter Kratzer und Lichtspiegelungen<\/b><\/span> auf den in der eBay-Anzeige verwendeten Bildern eindeutig wieder.<\/span><\/li>\n<li><span style=\"color: #000000;\">Das Gericht hielt es f\u00fcr <span style=\"color: #080060;\"><b>ausgeschlossen<\/b>,<\/span> dass Fotos unterschiedlicher Fotografen derart optisch \u00fcbereinstimmen, wie es hier der Fall war.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #0d0063;\">Wie hoch wurde der Schadensersatzes gew\u00e4hrt wurde?<\/span>\u00a0<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Schadensersatz wurde im Rahmen der gerichtlichen <span style=\"color: #080060;\"><b>Sch\u00e4tzung gem\u00e4\u00df <span style=\"color: #0d0063;\"><a style=\"color: #0d0063;\" href=\"https:\/\/www.gesetze-im-internet.de\/zpo\/__287.html\">\u00a7 287 ZPO<\/a><\/span><\/b> <\/span>festgelegt. Die Sch\u00e4tzung erfolgte nach der fiktiven Lizenzgeb\u00fchr.\u00a0<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Qualit\u00e4t des Fotos ma\u00dfgeblich:<\/b> <\/span>Das Gericht stellte fest, dass die Fotos I die <span style=\"color: #080060;\"><b>Qualit\u00e4t eines professionellen Produktfotos<\/b><\/span> aufweisen. Obwohl der Fotograf auch M\u00fcnzh\u00e4ndler ist, verf\u00fcge er offensichtlich \u00fcber die erforderlichen Kenntnisse und Ausr\u00fcstung eines <span style=\"color: #080060;\"><b>Profi-Fotografen<\/b><\/span>.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Wertsch\u00e4tzung:<\/b><\/span> Die Fotos wurden als ansprechend gestaltet und <span style=\"color: #080060;\"><b>werbend<\/b><\/span> f\u00fcr den Verkauf von M\u00fcnzen eingesetzt.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>H\u00f6he:<\/b><\/span> Das Gericht bewertete den Schadensersatz f\u00fcr jedes der beiden professionellen M\u00fcnzfotos mit<span style=\"color: #080060;\"> <b>je 100,- \u20ac<\/b>.<\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Beklagte wurde zur Zahlung eines Betrages in H\u00f6he von<span style=\"color: #080060;\"> <b>200,00 \u20ac<\/b><\/span> (2 x 100 \u20ac) nebst Zinsen verurteilt.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die entscheidenden juristischen Erw\u00e4gungen sind hier die <span style=\"color: #080060;\"><b>Best\u00e4tigung des Urheberrechtsschutzes f\u00fcr Produktfotos<\/b><\/span> (Lichtbilder), der <span style=\"color: #080060;\"><b>eindeutige Nachweis der Kopie<\/b><\/span> (durch Merkmale wie Kratzer\/Lichtspiegelungen) und die <span style=\"color: #080060;\"><b>Bemessung des fiktiven Schadensersatzes<\/b>
