Der Kl\u00e4ger f\u00fchlte sich dadurch \u00fcberwacht, da die Kameras auch sein Grundst\u00fcck, Zuwegungen und \u00f6ffentliche Bereiche erfassen konnten.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Entscheidung des Gerichts: Video\u00fcberwachung am Reihenhaus<\/span><\/h4>\n<p>&nbsp;<\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Hauptantrag (Entfernung der Kameras):<\/strong><\/span> Abgewiesen \u2717<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Hilfsantrag (Unterlassung der Erfassung fremder Bereiche):<\/strong><\/span> Stattgegeben \u2713<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Die Beklagten <span style=\"color: #080060;\"><strong>m\u00fcssen verhindern<\/strong>,<\/span> dass ihre Kameras das Nachbargrundst\u00fcck, Zuwegungen oder \u00f6ffentliche Bereiche erfassen, sie m\u00fcssen die Kameras aber <strong>nicht entfernen<\/strong>.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Technische Feststellungen des Sachverst\u00e4ndigen:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Die drei Kameras konnten bei entsprechender Einstellung:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">den Eingangsbereich und Garten des Kl\u00e4gers erfassen,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">die Balkonkamera erfasste fast vollst\u00e4ndig den hinteren Gartenbereich,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">dabei waren die Kameras leicht verstellbar (2 Minuten mit Werkzeug),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">und zum Zeitpunkt der Begutachtung waren sie korrekt eingestellt,<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Rechtliche Bewertung:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>1. Pers\u00f6nlichkeitsrechtsverletzung bejaht:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Video\u00fcberwachung greift in das <span style=\"color: #080060;\"><strong>Recht auf informationelle Selbstbestimmung<\/strong><\/span> ein (Art. 2 Abs. 1 i.V.m. Art. 1 Abs. 1 GG)!<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Das gilt auch f\u00fcr <span style=\"color: #080060;\"><strong>potenzielle Erfassungsm\u00f6glichkeiten!<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Grundsatz (BGH): Weder \u00f6ffentlicher Bereich noch Nachbargrundst\u00fccke d\u00fcrfen erfasst werden.<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>2. Aber: Keine vollst\u00e4ndige Beseitigung erforderlich:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht f\u00fchrte eine <span style=\"color: #080060;\"><strong>Einzelfallabw\u00e4gung<\/strong><\/span> durch.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>F\u00fcr den Kl\u00e4ger sprechen:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">tats\u00e4chliche Erfassungsm\u00f6glichkeit seines Grundst\u00fccks,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">leichte Verstellbarkeit der Kameras,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">eskalierender Nachbarschaftskonflikt,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">mehrere Schiedsverfahren bereits gelaufen.<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>F\u00fcr die Beklagten sprechen:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Grundrecht auf<span style=\"color: #080060;\"> <strong>Selbstbestimmung \u00fcber eigenes Grundst\u00fcck,<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">legitimes Interesse an Einbruchsschutz,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Kameras waren zum Zeitpunkt der Pr\u00fcfung korrekt eingestellt,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Anerkennung des Unterlassungsanspruchs signalisiert guten Willen,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">\u00f6ffentliche Hinweisschilder auf Video\u00fcberwachung.<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>3. Verh\u00e4ltnism\u00e4\u00dfige L\u00f6sung:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht entschied, dass <span style=\"color: #080060;\"><strong>mildere Mittel ausreichen<\/strong>:<\/span><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">\u00c4u\u00dfere Sichtblenden\/Geh\u00e4use anbringen!<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Stellschrauben durchbohren oder zus\u00e4tzlich verschrauben!<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Drehhalterungen unbrauchbar machen!<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Keine komplette Entfernung<\/strong><\/span> n\u00f6tig.<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>4. &#8222;\u00dcberwachungsdruck&#8220; verneint:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Kl\u00e4ger argumentierte mit subjektivem \u00dcberwachungsdruck. Das Gericht:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">erkannte an, dass ein Nachbarschaftskonflikt besteht,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">verwies aber auf BGH-Rechtsprechung: <em>Kein Beseitigungsanspruch, wenn Kameras nur mit<span style=\"color: #080060;\"> <strong>erheblichem, \u00e4u\u00dferlich wahrnehmbarem Aufwand<\/strong> <\/span>verstellbar sind!<\/em><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Die angeordneten Sicherungsma\u00dfnahmen erf\u00fcllen diese Anforderung.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Die H\u00f6he des Zwangsmittels (bis 250.000 \u20ac Ordnungsgeld) wirkr abschreckend.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Fazit: Video\u00fcberwachung am Reihenhaus<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Es bedarf einer Abw\u00e4gung im Einzelfall, ob neben der Unterlassung der Erfassung des fremden Privatgrundst\u00fccks nebst Zuwegung und dem \u00f6ffentlichen Bereich die Unterlassung jeglicher Video\u00fcberwachung vom Grundst\u00fccksnachbarn verlangt werden kann.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Kernaussagen des Urteils:<\/strong><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Video\u00fcberwachung des <span style=\"color: #080060;\"><strong>eigenen Grundst\u00fccks<\/strong><\/span> ist grunds\u00e4tzlich zul\u00e4ssig.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Erfassung fremder Grundst\u00fccke\/\u00f6ffentlicher Bereiche ist <span style=\"color: #080060;\"><strong>unzul\u00e4ssig.<\/strong><\/span><\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Verh\u00e4ltnism\u00e4\u00dfigkeitsgrundsatz beachten:<\/strong> <\/span>Vollst\u00e4ndige Beseitigung nur, wenn mildere Mittel nicht ausreichen!<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Technische Sicherungen (Blenden, Verschraubungen) k\u00f6nnen ausreichend sein.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Auch bei <span style=\"color: #080060;\"><strong>Nachbarschaftskonflikten<\/strong> <\/span>muss nicht sofort entfernt werden, wenn Missbrauch durch Zwangsmittel verhindert werden kann.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Einzelfallabw\u00e4gung<\/strong><\/span> zwischen Sicherheitsbed\u00fcrfnis und Pers\u00f6nlichkeitsschutz erforderlich.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil zeigt einen<span style=\"color: #080060;\"> <strong>ausgewogenen Mittelweg<\/strong><\/span> zwischen:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Recht auf Video\u00fcberwachung des eigenen Grundst\u00fccks,<\/span><\/li>\n<li
