Sie besch\u00e4ftigt sich mit der Verwendung fremder Produktbilder zu Verkaufszwecken.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #0d0063;\">\u00a0Sachverhalt: Urheberrechtsverletzung auf Ebay<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die Kl\u00e4gerin hatte 13 Produktfotos eines Markenschals f\u00fcr eine eBay-Auktion erstellt. Die Beklagte kaufte den Schal und versteigerte ihn sp\u00e4ter selbst wieder auf eBay. Dabei nutzte sie die 13 Originalfotos der Kl\u00e4gerin, ohne deren Erlaubnis einzuholen oder sie als Urheberin zu nennen. Die Kl\u00e4gerin mahnte die Beklagte ab. Die Beklagte gab die Unterlassungserkl\u00e4rung ab und zahlte insgesamt <span style=\"color: #080060;\"><strong>750 \u20ac Schadensersatz<\/strong><\/span> (ca. 57 \u20ac pro Bild) sowie <span style=\"color: #080060;\"><strong>839,80 \u20ac Abmahnkosten<\/strong><\/span>. Die Kl\u00e4gerin forderte jedoch deutlich mehr: Sie verlangte 100 \u20ac Lizenzgeb\u00fchr pro Bild, was sie wegen der fehlenden Urheberbenennung verdoppeln wollte (insgesamt 1.300 \u20ac + 1.300 \u20ac = 2.600 \u20ac). Zudem forderte sie h\u00f6here Abmahnkosten basierend auf einem Streitwert von 26.000 \u20ac.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Entscheidungsgr\u00fcnde: Urheberrechtsverletzung auf Ebay<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Amtsgericht D\u00fcsseldorf hat die Klage abgewiesen, da die Anspr\u00fcche durch die bereits geleisteten Zahlungen der Beklagten abgegolten seien.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Schadensersatzh\u00f6he:<\/strong><\/span> Das Gericht hielt die gezahlten 750 \u20ac f\u00fcr ausreichend. Zwar dienen die MFM-Empfehlungen (Mittelstandsgemeinschaft Foto-Marketing) oft als Orientierung, sie d\u00fcrfen aber nicht schematisch auf Privatpersonen angewendet werden. Da es sich um &#8222;einfache Produktfotos&#8220; handelte (teils unscharf, schlechte Ausleuchtung, einfacher Hintergrund), sei ein deutlicher Abschlag von den Profi-S\u00e4tzen gerechtfertigt.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Keine Verdoppelung des Schadensersatzes:<\/strong><\/span> Ein Zuschlag von 100 % wegen unterlassener Urheberbenennung wurde abgelehnt. Das Gericht begr\u00fcndete dies damit, dass die Fotos keine professionelle Qualit\u00e4t hatten. Ein Werbeeffekt durch Namensnennung, der bei Profi-Fotografen einen wirtschaftlichen Wert darstellt, sei bei solchen Hobbyaufnahmen nicht anzunehmen.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Abmahnkosten\/Streitwert:<\/strong><\/span> Der Streitwert wurde mit 19.500 \u20ac f\u00fcr die Unterlassung (degressiv gestaffelt: 3.000 \u20ac f\u00fcr das erste Bild, dann sinkend) plus Schadensersatz bemessen. Die bereits gezahlten Geb\u00fchren deckten diesen Wert ab.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #0d0063;\">Wesentliche Gedanken (Kernpunkte): Urheberrechtsverletzung auf Ebay<\/span><\/h3>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Keine schematische MFM-Anwendung:<\/strong> <\/span>Die Honorars\u00e4tze f\u00fcr Profi-Fotografen k\u00f6nnen nicht eins zu eins auf Amateurfotos bei eBay \u00fcbertragen werden. Es ist eine Einzelfallpr\u00fcfung der Qualit\u00e4t erforderlich.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong><span style=\"color: #080060;\">Qualit\u00e4tsabh\u00e4ngiger<\/span> Urheberzuschlag:<\/strong> <\/span>Der \u201eVerletzerzuschlag\u201c wegen fehlender Namensnennung ist kein Automatismus. Er wird nur gew\u00e4hrt, wenn die Namensnennung f\u00fcr den Urheber einen echten wirtschaftlichen (Werbe-)Wert gehabt h\u00e4tte. Bei qualitativ minderwertigen Schnappsch\u00fcssen ist das nicht der Fall.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Degressiver Streitwert bei Bilderserien:<\/strong> <\/span>Werden viele Bilder aus derselben Serie (dasselbe Shooting) gleichzeitig verletzt, steigt der Streitwert nicht linear (Bildanzahl x Einzelwert), sondern es findet eine Pauschalierung bzw. Seit 1983 ermittelt sie j\u00e4hrlich die markt\u00fcblichen Honorare f\u00fcr Fotonutzungen in Deutschland und ver\u00f6ffentlicht diese in der Brosch\u00fcre <span style=\"color: #080060;\"><strong>&#8222;Bildhonorare&#8220;<\/strong>.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In der Welt des Urheberrechts ist die MFM-Tabelle das wohl wichtigste (und oft umstrittenste) Werkzeug zur Preisbestimmung. Hier sind die wichtigsten Details:<\/span><\/p>\n<p>&nbsp;<\/p>\n<h5 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Was macht die MFM genau?\u00a0<\/span><\/h5>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die MFM f\u00fchrt jedes Jahr eine umfangreiche Erhebung unter Fotografen und Bildagenturen durch. Ziel ist es, die tats\u00e4chlich am Markt erzielten Preise f\u00fcr Bildlizenzen zu dokumentieren. Die Ergebnisse werden nach verschiedenen Kriterien sortiert:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Medium:<\/strong><\/span> (z. B. 1 Woche, 1 Monat, 1 Jahr)<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Verwendungszweck:<\/strong><\/span> (Redaktionell vs. Kommerziell\/Werbung)<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong><span style=\"color: #080060;\">Platzierung<\/span>:<\/strong> (z. B. Unterseite vs. Homepage-Header)<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h5><span style=\"color: #0d0063;\">Welche Bedeutung hat die MFM-Empfehlung vor Gericht?<\/span><\/h5>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In Urheberrechtsprozessen dienen die MFM-Empfehlungen als <span style=\"color: #080060;\"><strong>zentrale Sch\u00e4tzgrundlage<\/strong><\/span> f\u00fcr Gerichte (\u00a7 287 ZPO), um den &#8222;Lizenzschadensersatz&#8220; festzulegen. Wenn jemand ein Bild ohne Erlaubnis nutzt, muss er den Betrag zahlen, den vern\u00fcnftige Parteien bei einem regul\u00e4ren Vertrag vereinbart h\u00e4tten.
