{"id":8486,"date":"2025-12-06T11:20:12","date_gmt":"2025-12-06T11:20:12","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8486"},"modified":"2025-12-06T11:52:50","modified_gmt":"2025-12-06T11:52:50","slug":"bildrecht-retweet-eines-profilbildes-auf-twitter","status":"publish","type":"post","link":"http:\/\/www.johanna-swist.de\/wpjs\/de\/bildrecht-retweet-eines-profilbildes-auf-twitter\/","title":{"rendered":"Bildrecht: Retweet eines Profilbildes auf Twitter, Amtsgericht K\u00f6ln, 111 C 569\/19, vom 22.04.2021"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Retweet eines Profilbildes auf Twitter<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine Entscheidung des Amtsgericht K\u00f6ln <span style=\"color: #080060;\"><strong>(AG K\u00f6ln, 111 C 562\/19, vom 22.04.2021)<\/strong><\/span> vor, die sich mit einem Retweet auf Twitter besch\u00e4ftigt.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Alle die regelm\u00e4\u00dfig in sozielan Netzwerken unterwegs sind, Ein altes, aber wichtiges Urteil des Amtsgerichts Essen kl\u00e4rt eine Grundsatzfrage im Fotorecht: Wer ist der Eigent\u00fcmer der Negative, wenn der Kunde nur die fertigen Abz\u00fcge bestellt hat?<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Retweet eines Profilbildes auf Twitter<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Kl\u00e4ger (Journalist) und Beklagter (ebenfalls Journalist) sind beide Nutzer der Plattform <span style=\"color: #080060;\"><strong>Twitter<\/strong>. <\/span><\/span><span style=\"color: #000000;\">Der Kl\u00e4ger lie\u00df ein <span style=\"color: #080060;\"><strong>Portr\u00e4tbild<\/strong><\/span> von sich erstellen, welches er als Profilbild auf seinem Twitter-Account verwendete. <\/span><span style=\"color: #000000;\">Das Bild wurde zun\u00e4chst vom Pressesprecher einer Bundestagsfraktion in einem Tweet hochgeladen (unter einer anderen URL). Der Beklagte <span style=\"color: #080060;\"><strong>retweetete<\/strong><\/span> diesen Tweet, der das Portr\u00e4tfoto des Kl\u00e4gers enthielt, und baute das Bild damit in seinen eigenen Tweet ein. <\/span><span style=\"color: #000000;\">Der Kl\u00e4ger, der behauptete, das ausschlie\u00dfliche Nutzungsrecht an dem Bild zu besitzen, mahnte den Beklagten ab und forderte ihn zur Unterlassung auf. <\/span><span style=\"color: #000000;\">Der Beklagte gab eine Unterlassungserkl\u00e4rung ab, weigerte sich jedoch, die vom Kl\u00e4ger geltend gemachten <strong><span style=\"color: #080060;\">vorgerichtlichen<\/span> <span style=\"color: #080060;\">Rechtsanwaltskosten<\/span><\/strong> in H\u00f6he von <strong>5<span style=\"color: #080060;\">71,44 EUR<\/span><\/strong> zu zahlen. <\/span><span style=\"color: #000000;\">Der Kl\u00e4ger erhob Klage auf Zahlung dieser Kosten.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Rechtliche \u00dcberlegungen des Gerichts:\u00a0Retweet eines Profilbildes auf Twitter<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht pr\u00fcfte, ob die Abmahnung des Kl\u00e4gers berechtigt war, was einen Unterlassungsanspruch wegen widerrechtlicher Verletzung eines gesch\u00fctzten Rechts (\u00a7 97 Abs. 1 UrhG) voraussetzt.<\/span><\/p>\n<p><span style=\"color: #080060;\"><strong>Keine urheberrechtliche Verletzung durch Retweet (Embedding)!<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Keine Vervielf\u00e4ltigung oder \u00f6ffentliche Zug\u00e4nglichmachung:<\/strong><\/span> Das Gericht stellte fest, dass ein <span style=\"color: #080060;\"><strong>Retweet<\/strong> <\/span>im Sinne des <span style=\"color: #080060;\"><strong>Embedding<\/strong><\/span> erfolgt, bei dem der fremde Inhalt nicht kopiert, sondern lediglich eingebunden wird. Daher liegt weder eine Vervielf\u00e4ltigung (\u00a7 <\/span><span style=\"color: #000000;\">16 UrhG) noch eine \u00f6ffentliche Zug\u00e4nglichmachung (\u00a7 19 UrhG) vor.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Kein &#8222;neues Publikum&#8220;:<\/strong><\/span> In Anlehnung an die Rechtsprechung des Europ\u00e4ischen Gerichtshofs (EuGH) liegt keine \u00f6ffentliche Wiedergabe (\u00a7 15 Abs. 2 UrhG) vor, wenn der Inhalt bereits zuvor mit Zustimmung des Rechtsinhabers der Gesamtheit der Internetnutzer <span style=\"color: #080060;\"><strong>unbeschr\u00e4nkt abrufbar<\/strong><\/span> gemacht wurde.<\/span>\n<ul>\n<li><span style=\"color: #000000;\">Das Gericht ging davon aus, dass der Kl\u00e4ger das streitgegenst\u00e4ndliche Bild <span style=\"color: #080060;\"><strong>selbst auf Twitter \u00f6ffentlich zug\u00e4nglich gemacht<\/strong><\/span> hat (was durch einen Screenshot des Profils belegt wurde).<\/span><\/li>\n<li><span style=\"color: #000000;\">Selbst wenn das Bild durch eine dritte Person (Herr T.) hochgeladen wurde, h\u00e4tte der Beklagte als Retweeter <span style=\"color: #080060;\"><strong>keine Gewinnerzielungsabsicht<\/strong> <\/span>gehabt. Ohne konkrete Anhaltspunkte daf\u00fcr, dass der Beklagte die Rechtswidrigkeit des Ursprungsinhalts erkennen konnte, sei eine Haftung nicht gegeben. Es k\u00f6nne nicht von jedem Twitternutzer verlangt werden, vor einem Retweet die Rechtm\u00e4\u00dfigkeit des Inhalts zu recherchieren.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong> Konkludente Einwilligung des Kl\u00e4gers?<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Zustimmung durch Upload:<\/strong> <\/span>Das Gericht sah in dem Umstand, dass der Kl\u00e4ger das Bild selbst auf Twitter hochgeladen und \u00f6ffentlich gestellt hat, eine <span style=\"color: #080060;\"><strong>konkludente (stillschweigende) Einwilligung<\/strong><\/span> in dessen Weiterverbreitung<span style=\"color: #080060;\"> (<strong>Retweeten<\/strong>)<\/span> innerhalb der Plattform.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Wesen von Social-Media-Plattformen:<\/strong> <\/span>Die Nutzung von Twitter sei darauf ausgelegt, eine gr\u00f6\u00dftm\u00f6gliche Breitenwirkung zu erzielen. Wer Inhalte auf die Plattform stellt, muss mit der g\u00e4ngigen Praxis des Teilens\/Retweetens rechnen und stimmt der Nutzung im Rahmen der Plattform-Funktionalit\u00e4t zu.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Ergebnis:<\/strong><\/span> Die Nutzung des Bildes durch den Beklagten war somit <span style=\"color: #080060;\"><strong>nicht widerrechtlich<\/strong>.<\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Fazit: Retweet eines Profilbildes auf Twitter<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Die Entscheidung des Amtsgerichts K\u00f6ln ist <span style=\"color: #080060;\"><strong>sehr wichtig<\/strong><\/span> f\u00fcr die Kl\u00e4rung urheberrechtlicher Fragen im Zusammenhang mit Social-Media-Plattformen. Das gilt insbesondere f\u00fcr die Nutzung der <span style=\"color: #080060;\"><strong>Retweet-Funktion<\/strong><\/span> auf Twitter.
