Urteil zur Eigentumsfrage bei Hochzeitsfotos<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine ziemlich alte Entscheidung des Amtsgericht Essen <span style=\"color: #080060;\"><strong>(AG Es<span style=\"color: #080060;\">s<\/span>en, 14 C 562\/88, vom 31.10.1988) <\/strong><\/span>in Zusammenhang mit m\u00f6glichen Schadensersatzanspr\u00fcchen wegen einer unrechtm\u00e4\u00dfigen Benutzung eines Thumbnails vor.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Hier: Ein altes, aber wichtiges Urteil des Amtsgerichts Essen kl\u00e4rt eine Grundsatzfrage im Fotorecht: Wer ist der Eigent\u00fcmer der Negative, wenn der Kunde nur die fertigen Abz\u00fcge bestellt hat?<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Eigentum am Negativ<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Amtsgericht Essen (Urteil vom 31.10.1988, Az. 12 C 562\/88) musste \u00fcber die Klage eines Kunden entscheiden, der nach seiner Hochzeit Fotos in einem Studio anfertigen lie\u00df und anschlie\u00dfend die <span style=\"color: #080060;\"><b>Herausgabe und \u00dcbereignung der Negative<\/b><\/span> der ausgew\u00e4hlten Bilder verlangte. Der Kl\u00e4ger argumentierte, die Negative seien Teil der geschuldeten handwerklichen Leistung (Werkvertrag).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht wies die Klage ab und stellte klar:<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Kein Anspruch auf die Negative ohne klare Abrede\u00a0<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Vertrag zwischen dem Kunden und dem Fotografen wurde als <span style=\"color: #080060;\"><b>Werkvertrag<\/b><\/span> eingestuft. Das Gericht betonte, dass der Fotograf damit verpflichtet sei, die bestellten <span style=\"color: #080060;\"><b>Fotoabz\u00fcge<\/b> <\/span>herzustellen und zu \u00fcbereignen.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Eine Pflicht zur \u00dcbereignung der <span style=\"color: #080060;\"><b>Negative<\/b><\/span> folgt aus dieser grunds\u00e4tzlichen Rechtslage jedoch nicht. Da die Parteien beim Vertragsabschluss <span style=\"color: #080060;\"><b>nicht ausdr\u00fccklich<\/b><\/span> \u00fcber das Eigentum an den Negativen gesprochen hatten, sei im Zweifel davon auszugehen, dass <span style=\"color: #080060;\"><b>keine Pflicht zur Eigentumsverschaffung<\/b> <\/span>vereinbart wurde.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Das Negativ verbleibt beim Berufsfotografen\u00a0<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht st\u00fctzte sich auf die g\u00e4ngige <span style=\"color: #080060;\"><b>Verkehrssitte<\/b><\/span> und die historische Rechtsprechung (Reichsgericht). Es f\u00fchrte aus, dass es der <span style=\"color: #080060;\"><b>Regelfall<\/b><\/span> sei, dass der Berufsfotograf die Negative (oder heute die digitalen Dateien) als <span style=\"color: #080060;\"><b>sein Eigentum beh\u00e4lt<\/b><\/span> und aufbewahrt. Dies dient dazu, bei k\u00fcnftigen Bestellungen neue Abz\u00fcge gegen Entgelt liefern zu k\u00f6nnen.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Trennung von Eigentum und Urheberrecht\u00a0<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil unterstreicht die wichtige Trennung zwischen verschiedenen Rechten:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Eigentum am Negativ:<\/b><\/span> Dies verbleibt im Zweifel beim Fotografen.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Urheberrecht:<\/b> <\/span>Die Rechte zur Vervielf\u00e4ltigung stehen grunds\u00e4tzlich dem Urheber, also dem Fotografen, zu<a style=\"color: #000000;\" href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__16.html\"> (\u00a7 16 UrhG).<\/a><\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Ver\u00f6ffentlichungsrecht des Kunden:<\/b><\/span> Der Kunde ist jedoch als Abgebildeter gesch\u00fctzt. Der Fotograf darf die Aufnahmen nur mit Einwilligung des Kunden (hier des Kl\u00e4gers und seiner Ehefrau) ver\u00f6ffentlichen <a style=\"color: #000000;\" href=\"https:\/\/www.gesetze-im-internet.de\/kunsturhg\/__22.html\">(\u00a7 22 KunstUrhG)<\/a>.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Privatkopie:<\/b> <\/span>Der Kunde als Eigent\u00fcmer der Fotoabz\u00fcge kann f\u00fcr den privaten Gebrauch Vervielf\u00e4ltigungen (z.B. Scans oder Kopien) herstellen lassen und verwenden (<a style=\"color: #000000;\" href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__53.html\">\u00a7 53 Abs. 1 UrhG)<\/a>.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Fazit f\u00fcr Kunden und Fotografen<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Kunden m\u00fcssen die <span style=\"color: #080060;\"><b>\u00dcbereignung der Negative oder Originaldateien<\/b><\/span> (RAW, hochaufl\u00f6sende JPEGs) <span style=\"color: #080060;\"><b>ausdr\u00fccklich vertraglich vereinbaren<\/b>,<\/span> wenn sie diese f\u00fcr eigene Zwecke (z.B. Drucke bei Drittanbietern) nutzen m\u00f6chten. Andernfalls verbleibt das Eigentum am Negativ beim Fotografen.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Bei diesem Fall handelt es sich um einen Einzelfall.
