{"id":8302,"date":"2025-11-29T16:51:54","date_gmt":"2025-11-29T16:51:54","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8302"},"modified":"2025-11-30T09:36:24","modified_gmt":"2025-11-30T09:36:24","slug":"bildrecht-produktfotos","status":"publish","type":"post","link":"http:\/\/www.johanna-swist.de\/wpjs\/de\/bildrecht-produktfotos\/","title":{"rendered":"Bildrecht: Produktfotos, Amtsgericht K\u00f6ln, 125 C 417\/09, vom 31.03.2010"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Produktfotos &#8211; Urheberrecht auf eBay<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine eetwas \u00e4ltere Entscheidung des Amtsgericht K\u00f6ln <span style=\"color: #080060;\"><strong>(AG K\u00f6ln, <span style=\"color: #080060;\">125<\/span> C 417\/09, vom 31.03.2010) <\/strong><\/span>in Zusammenhang mit Produktfotos, die auf Ebay ver\u00f6ffentlicht worden sind.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">AG K\u00f6ln begrenzt Forderungen bei Privatverkauf<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Wichtige Klarstellung des Amtsgerichts K\u00f6ln:<\/strong><\/span> Bei der unbefugten Nutzung von Produktfotos im Rahmen eines privaten eBay-Verkaufs sind Lizenzforderungen und Abmahnkosten deutlich zu begrenzen.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In seinem Urteil vom 31.03.2010 (Az. 125 C 417\/09) entschied das Amtsgericht K\u00f6ln \u00fcber die Klage einer Anwaltskanzlei, die abgetretene Anspr\u00fcche aus einer Urheberrechtsverletzung geltend machte. Eine<span style=\"color: #080060;\"> <b>Privatverk\u00e4uferin<\/b><\/span> hatte bei der Versteigerung von drei Parf\u00fcmartikeln auf eBay <span style=\"color: #080060;\"><b>Produktfotos<\/b><\/span> verwendet, die urspr\u00fcnglich von einem gewerblichen H\u00e4ndler stammten. Die abmahnende Partei forderte daraufhin erhebliche Lizenzgeb\u00fchren und Abmahnkosten.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht wies die Klage weitgehend ab und traf wichtige Feststellungen zur H\u00f6he der Forderungen:<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Lizenzgeb\u00fchren stark reduziert<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Obwohl das Gericht die grunds\u00e4tzliche Anwendung der Honorarempfehlungen der MFM (Mittelstandsgemeinschaft Foto-Marketing) bejahte, wurden aufgrund der Umst\u00e4nde erhebliche Abz\u00fcge vorgenommen:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Kein Berufsfotograf \/ Private Nutzung:<\/b><\/span> Der Fotograf war kein Berufsfotograf und die Beklagte nutzte die Fotos lediglich f\u00fcr drei private Einzelverk\u00e4ufe.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Kein Zuschlag f\u00fcr fehlende Urheberbenennung:<\/b> <\/span>Der von der Kl\u00e4gerin geforderte 100%ige Zuschlag wegen fehlender Namensnennung wurde abgelehnt. Das Urheberpers\u00f6nlichkeitsrecht sei bei einfachen <span style=\"color: #080060;\"><b>Produktfotografien eines Hobby-Fotografen<\/b> <\/span>nicht nennenswert beeintr\u00e4chtigt.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Mengenrabatt:<\/b><\/span> Bei der Nutzung mehrerer Fotos (hier 3) ist ein Mengenrabatt angemessen (analog zu den Tarifen der Verwertungsgesellschaft Bild).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Das Ergebnis:<\/b><\/span> Das Gericht setzte die angemessene Lizenzgeb\u00fchr f\u00fcr alle drei Fotos zusammen auf<span style=\"color: #080060;\"> <b>180,00 \u20ac<\/b><\/span> fest, obwohl die Kl\u00e4gerin deutlich mehr (urspr\u00fcnglich 1.350,00 \u20ac) verlangt hatte.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Abmahnkosten auf 100 \u20ac begrenzt<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht stellte klar, dass es sich um einen <span style=\"color: #080060;\"><b>einfach gelagerten Fall<\/b> <\/span>au\u00dferhalb des gesch\u00e4ftlichen Verkehrs handelte, da die Beklagte die Artikel im Rahmen eines <span style=\"color: #080060;\"><b>reinen Privatverkaufs<\/b><\/span> versteigerte.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Daher fand <a href=\"https:\/\/www.gesetze-im-internet.de\/urhg\/__97a.html\"><span style=\"color: #080060;\"><b>\u00a7 97a Abs. 2 UrhG<\/b><\/span><\/a> (die sogenannte &#8222;Kappung&#8220;) Anwendung. Die zu erstattenden Abmahngeb\u00fchren wurden auf <b>100,00 \u20ac<\/b> begrenzt.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Fazit des Urteils zu fremden Produktfotos<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil st\u00e4rkt die Position von Privatverk\u00e4ufern auf Plattformen wie eBay.
