Im Vordergrund steht die Frage, in welcher Frist ein Internet-Forennutzungsvertrag ordentlich gek\u00fcndigt werden kann.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Sachverhalt: Ausschluss aus einer Social-Media-Plattform <\/span><\/h4>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Nutzer eines Drohnen-Forums wurde teilweise gesperrt (keine Schreibrechte mehr, nur Lesezugriff), weil der Forenbetreiber ihm vorwarf, gewerblich\/werblich f\u00fcr den Drohnenhersteller &#8222;Z&#8220; t\u00e4tig zu sein. Der Nutzer hatte \u00fcber 900 Beitr\u00e4ge verfasst, u.a. ausf\u00fchrliche Posts \u00fcber Z-Drohnen mit Fotos, die im H\u00e4ndlergesch\u00e4ft mit Werbebannern im Hintergrund entstanden waren. Er betrieb zudem einen YouTube-Kanal mit Drohnenvideos und Hinweis auf &#8222;Unterst\u00fctzung&#8220; durch Z.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Entscheidung des Gerichts: Ausschluss aus einer Social-Media-Plattform<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Der Klage hat das Gericht vollumf\u00e4nglich stattgegeben:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-decimal space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Freischaltung des Accounts<\/strong><\/span> angeordnet!<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Erstattung vorgerichtlicher Anwaltskosten<\/strong><\/span> (179,27 \u20ac) plus Zinsen!<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\"><span style=\"color: #0d0063;\">Zentrale rechtliche Bewertungen:<\/span><\/h5>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">Zustandekommen eines Forennutzungsvertrags<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Das Gericht entschied:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">durch die Anmeldung im Forum entsteht ein <span style=\"color: #080060;\"><strong>wirksamer Vertrag<\/strong><\/span> (\u00a7\u00a7 145 ff. BGB),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">es war <span style=\"color: #080060;\"><strong>kein blo\u00dfes &#8222;Angebot zum Angebot&#8220;<\/strong> <\/span>(invitatio ad offerendum), sondern <span style=\"color: #080060;\"><strong>echtes Vertragsangebot<\/strong> <\/span>des Betreibers,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Rechtsbindungswille<\/strong><\/span> liegt vor, weil:<\/span>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Nutzungsbedingungen existieren,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">diese bei Anmeldung akzeptiert werden m\u00fcssen,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">keine anonymen Beitr\u00e4ge m\u00f6glich sind (Registrierung erforderlich),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">keine manuelle Pr\u00fcfung\/Freigabe neuer Nutzer erfolgt.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">Dauerschuldverh\u00e4ltnis mit K\u00fcndigungsschutz<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Art des Vertrags:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Es handelt sich um ein <span style=\"color: #080060;\"><strong>Dauerschuldverh\u00e4ltnis<\/strong><\/span> (\u00a7 314 BGB),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">st\u00e4ndig neue Leistungs-, Neben- und Schutzpflichten,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">auf Dauer angelegt (privates Postfach, Online-Identit\u00e4t).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">K\u00fcndigungsfristen &#8211; Leitsatz des Urteils<\/span><\/h6>\n<p>&nbsp;<\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>ordentliche K\u00fcndigung: 6 Monate Frist<\/strong><\/span> (\u00a7 624 S. 2 BGB analog),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Forennutzungsvertrag kommt <span style=\"color: #080060;\"><strong>Dienstvertrag am n\u00e4chsten,<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">bei nicht typisierten Dauerschuldverh\u00e4ltnissen: R\u00fcckgriff auf typisierte Vertr\u00e4ge.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Im vorliegenden Fall:<\/span><\/h6>\n<p>&nbsp;<\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">K\u00fcndigung erkl\u00e4rt: Oktober\/November 2016,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Vertrag endet fr\u00fchestens: Mai 2017,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">daher bestand der Vertrag zum Zeitpunkt der Entscheidung (April 2017) noch fort.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Die<span style=\"color: #080060;\"> <strong>fristlose K\u00fcndigung war unwirksam.<\/strong><\/span><\/span><\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Der Betreiber k\u00fcndigte au\u00dferordentlich fristlos (\u00a7 314 BGB), aber:<\/span><\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Erforderlich w\u00e4re gewesen:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>wichtiger Grund<\/strong><\/span> (z.B. Pflichtverletzung) und<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>erfolglose Abmahnung<\/strong><\/span> des Nutzers.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Das Gericht stellte fest:<\/span><\/h6>\n<p>&nbsp;<\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">eine Abmahnung erfolgte im Mai 2016 (Kontaktaufnahme + Teilsperrung),<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">diese war aber <span style=\"color: #080060;\"><strong>nicht erfolglos,<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">nach der Abmahnung kein weiteres vertragswidriges Verhalten,<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">YouTube-Aktivit\u00e4ten sind <span style=\"color: #080060;\"><strong>kein Versto\u00df<\/strong><\/span> gegen den Forennutzungsvertrag<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">daher: <span style=\"color: #080060;\"><strong>Fristlose K\u00fcndigung rechtswidrig.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">AGB-Klausel unwirksam (\u00a7 307 BGB)<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Die Nutzungsbedingungen enthielten:<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"padding-left: 80px;\"><em><span style=\"color: #000000;\">&#8222;Die Administratoren und Moderatoren behalten sich das Recht vor, Benutzer jederzeit und ohne Angabe von Gr\u00fcnden zu l\u00f6schen oder vor\u00fcbergehend zu sperren.&#8220;<\/span><\/em><\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Gericht:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Diese Klausel verst\u00f6\u00dft gegen <span style=\"color: #080060;\"><strong>\u00a7 307, 308 Nr. 4 BGB<\/strong><\/span> (unangemessene Benachteiligung)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Sie erlaubt <span style=\"color: #080060;\"><strong>willk\u00fcrliche Vertragsanpassung<\/strong><\/span> ohne Zumutbarkeitskontrolle<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Unwirksam<\/strong><\/span> nach AGB-Recht<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">Virtuelles Hausrecht begrenzt durch Vertrag<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Grunds\u00e4tzlich:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Der Betreiber einer Internetseite hat <span style=\"color: #080060;\"><strong>virtuelles Hausrecht.<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Er kann grunds\u00e4tzlich bestimmen, wer Zugang erh\u00e4lt.<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Aber:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Das virtuelle Hausrecht ist <span style=\"color: #080060;\"><strong>nicht grenzenlos.<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Es wird <span style=\"color: #080060;\"><strong>\u00fcberlagert durch vertragliche Beziehungen.<\/strong><\/span><\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Nach Vertragsschluss ist Nutzer nicht mehr &#8222;beliebiger Dritter&#8220;.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>\u00a7 241 Abs. 2 BGB<\/strong><\/span> (R\u00fccksichtnahmepflicht) gilt.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Sperrung nicht mehr anlasslos m\u00f6glich.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Bei Pflichtverletzung: <span style=\"color: #080060;\"><strong>Abmahnung erforderlich.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\">Teilsperrung rechtswidrig<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Das Gericht entschied:<\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Der Betreiber hatte <span style=\"color: #080060;\"><strong>keine Berechtigung<\/strong> <\/span>zur Teilsperrung<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Weder aus AGB (unwirksam)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Noch aus virtuellem Hausrecht (durch Vertrag begrenzt)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Noch aus gesetzlichen Regelungen (\u00a7\u00a7 320, 273 BGB nicht einschl\u00e4gig)<\/span><\/li>\n<\/ul>\n<h6><span style=\"color: #0d0063;\">Schadensersatz: Anwaltskosten<\/span><\/h6>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Betreiber setzte sich in <span style=\"color: #080060;\"><strong>Verzug<\/strong> <\/span>(\u00a7 280, 286 BGB).<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Er erkl\u00e4rte &#8222;ernsthaft und endg\u00fcltig&#8220;, weitere E-Mails nicht mehr zu beantworten.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Vorgerichtliche Anwaltskosten sind <span style=\"color: #080060;\"><strong>erstattungsf\u00e4hig.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\"><span style=\"color: #0d0063;\">Kernaussagen des Urteils: Ausschluss aus einer Social-Media-Plattform<\/span><\/h4>\n<ul>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Forennutzungsvertr\u00e4ge sind echte, rechtsverbindliche Vertr\u00e4ge.<\/strong><\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>6 Monate K\u00fcndigungsfrist<\/strong><\/span> bei ordentlicher K\u00fcndigung (analog \u00a7 624 S. 2 BGB)!<\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Fristlose K\u00fcndigung nur mit wichtigem Grund und nach erfolgloser Abmahnung!<\/strong><\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>&#8222;Jederzeit ohne Grund sperren&#8220;-Klauseln sind AGB-rechtlich unwirksam!<\/strong><\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Virtuelles Hausrecht wird durch Vertragsschluss begrenzt<\/strong><\/span> &#8211; Betreiber kann nicht mehr willk\u00fcrlich sperren!<\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Teilsperrungen (z.B. nur Leserecht) sind genauso zu behandeln wie Vollsperrungen!<\/strong><\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Online-Identit\u00e4t hat Schutzwert<\/strong><\/span> &#8211; Nutzer investieren Zeit und Reputation.<\/span><\/li>\n<li class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Au\u00dfervertragliche Aktivit\u00e4ten<\/strong><\/span> (hier: YouTube) sind kein K\u00fcndigungsgrund f\u00fcr Forenvertrag.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\"><span style=\"color: #0d0063;\">Praktische Bedeutung:\u00a0Ausschluss aus einer Social-Media-Plattform<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\"><span style=\"color: #080060;\"><strong>Forenbetreiber sollten beachten:<\/strong><\/span><\/p>\n<ul
