Stock)<\/span><\/li>\n<li data-path-to-node=\"3,4,0\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>\u00dcberwachungsbereich:<\/b><\/span> Der gemeinschaftliche Hauseingang (\u00f6ffentlich zug\u00e4nglicher Bereich)<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Die zentrale rechtliche Bewertung: Kamera-Attrappe!<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"10\"><span style=\"color: #000000;\">Das Gericht bejahte den <span style=\"color: #080060;\"><b>Unterlassungsanspruch<\/b><\/span> des Kl\u00e4gers gem\u00e4\u00df<span style=\"color: #080060;\"> <b>\u00a7\u00a7 823, 1004 BGB<\/b>.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Die Attrappe als Eingriff in das Pers\u00f6nlichkeitsrecht?<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"12\"><span style=\"color: #000000;\">Das AG Aachen stellte klar, dass f\u00fcr die Verletzung des <span style=\"color: #080060;\"><b>Pers\u00f6nlichkeitsrechts von Mietern<\/b><\/span> nicht die Funktionalit\u00e4t der Kamera entscheidend ist. Der Kern des rechtswidrigen Handelns liegt im <span style=\"color: #080060;\"><b>\u00dcberwachungsdruck<\/b>.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"12\"><span style=\"color: #080060;\"><b>Schl\u00fcsselaussage:<\/b> <\/span><\/p>\n<p style=\"text-align: justify; padding-left: 80px;\" data-path-to-node=\"12\"><em><span style=\"color: #000000;\">&#8222;Allein in dem bei ihm entstehenden <span style=\"color: #080060;\"><b>Eindruck des Anfertigens einer Filmaufnahme<\/b><\/span> liegt aber schon ein Eingriff in sein Allgemeines Pers\u00f6nlichkeitsrecht.&#8220;<\/span><\/em><\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Fehlende Rechtfertigung f\u00fcr die \u00dcberwachung<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"15\"><span style=\"color: #000000;\">Die Beklagten konnten <span style=\"color: #080060;\"><b>keinen Rechtfertigungsgrund<\/b><\/span> nachweisen, um die \u00dcberwachungsma\u00dfnahme zu legitimieren:<\/span><\/p>\n<ul style=\"text-align: justify;\" data-path-to-node=\"16\">\n<li>\n<p data-path-to-node=\"16,0,0\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Schutz des Hauseingangs:<\/b><\/span> Die Beklagten sind lediglich Mieter. Der begr\u00fcndete Verdacht auf Sachbesch\u00e4digung (\u00a7 303 StGB) am Gemeinschaftseigentum kann allenfalls dem <span style=\"color: #080060;\"><b>Vermieter\/Eigent\u00fcmer<\/b><\/span> ein Recht zur Installation geben.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"16,1,0\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Schutz des Privateigentums:<\/b><\/span> Die Behauptungen \u00fcber Besch\u00e4digungen des Privateigentums (z. B. W\u00e4schespinne) waren <span style=\"color: #080060;\"><b>unzureichend substantiiert<\/b>.<\/span> Zudem war die Attrappe nicht einmal auf diesen Bereich ausgerichtet.<\/span><\/p>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 data-path-to-node=\"16,1,0\"><span style=\"color: #0d0063;\">Ergebnis und praktische Bedeutung:<\/span><\/h4>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"18\"><span style=\"color: #000000;\">Der Richterspruch ist von gro\u00dfer <span style=\"color: #080060;\"><b>praktischer Bedeutung<\/b><\/span> f\u00fcr das <span style=\"color: #080060;\"><b>Mietrecht<\/b><\/span> und die <span style=\"color: #080060;\"><b>R\u00fccksichtnahmepflicht<\/b><\/span> in Mehrfamilienh\u00e4usern:<\/span><\/p>\n<ul style=\"text-align: justify;\" data-path-to-node=\"19\">\n<li>\n<p data-path-to-node=\"19,0,0\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><b>Unterlassungsanspruch:<\/b> <\/span>Der Antrag auf Unterlassung einer &#8222;echten&#8220; Kamera schlie\u00dft als <span style=\"color: #080060;\"><b>wesensgleiches Minus<\/b><\/span> automatisch die Unterlassung einer Attrappe gemeinschaftlich genutzte Bereiche eines Mehrfamilienhauses nicht ohne triftigen, dokumentierten und gerechtfertigten Grund durch Kameras (oder Attrappen) \u00fcberwachen, da dies die Grundrechte der
