{"id":8281,"date":"2025-12-27T14:57:48","date_gmt":"2025-12-27T14:57:48","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8281"},"modified":"2025-12-28T14:41:09","modified_gmt":"2025-12-28T14:41:09","slug":"nutzung-fremder-bilder","status":"publish","type":"post","link":"http:\/\/www.johanna-swist.de\/wpjs\/de\/nutzung-fremder-bilder\/","title":{"rendered":"Bildrecht: Nutzung fremder Bilder, Amtsgericht K\u00f6ln, 125 C 23\/22, vom 20.06.2023"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Nutzung fremder Bilder<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine Entscheidung des Amtsgericht K\u00f6ln<span style=\"color: #080060;\"> <strong>(AG K\u00f6ln, 125 C 23\/22, vom 11.11.2003)<\/strong><\/span> vor, die sich mit der Nutzung fremder Bilder\u00a0 besch\u00e4ftigt.\u00a0 \u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Nutzung fremder Bilder<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Kl\u00e4ger, ein Berufsfotograf, fertigte Modefotografien f\u00fcr einen Trachtenmoden-Hersteller (P.). <\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Die Beklagte, ein Einzelh\u00e4ndler und Vertriebspartner von P., lud am 13.04.2012 drei Lichtbilder aus dem Downloadbereich von P. herunter und nutzte diese auf ihrer Website und Facebook &#8211; unter Entfernung der Copyright-Vermerke. Die Nutzung erfolgte \u00fcber mehrere Jahre (ca. 5,5-7 Jahre). Der Kl\u00e4ger hatte mit P. verschiedene Vereinbarungen \u00fcber Nutzungsrechte getroffen, u.a. eine Option f\u00fcr 1.000 \u20ac pro Bild zur Weitergabe an Vertriebspartner f\u00fcr 24 Monate.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Entscheidung des Gerichts: Nutzung fremder Bilder<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht verurteilte die Beklagte zur Zahlung von nur 159,40 \u20ac plus 36 \u20ac Rechtsanwaltskosten (von urspr\u00fcnglich geforderten \u00fcber 2.500 \u20ac). Die Klage wurde im \u00dcbrigen abgewiesen.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h5 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Wesentliche Begr\u00fcndung:<\/span><\/h5>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Verletzung des Urheberechts an den Bildern bejaht:<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Unberechtigte Nutzung der Lichtbilder (\u00a7 97 UrhG)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Leicht fahrl\u00e4ssiges und widerrechtliches Handeln der Beklagten<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Schadensberechnung (lizenzanaloger Schadensersatz):<\/strong><\/span><\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\" style=\"text-align: justify;\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Ablehnung der Kl\u00e4ger-Preisliste:<\/strong> <\/span>Das Gericht folgte mehreren OLG-Entscheidungen und lehnte die vom Kl\u00e4ger vorgelegte Preisliste ab, da keine entsprechende Lizenzierungspraxis am Markt nachgewiesen wurde<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Realistische Sch\u00e4tzung:<\/strong> <\/span>Basierend auf den tats\u00e4chlichen Vereinbarungen mit P. (1.000 \u20ac f\u00fcr ca. 200 Lizenznehmer = ca. 5 \u20ac pro Lizenznehmer f\u00fcr 2 Jahre) wurde gesch\u00e4tzt:<\/span>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">2 Website-Bilder: je 100-170 \u20ac (gestaffelt nach Nutzungsjahren, da Wert mit Zeit abnimmt)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">1 Facebook-Bild: 240 \u20ac (h\u00f6herer Wert wegen gr\u00f6\u00dferer Reichweite)<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Aufschlag 100%<\/strong><\/span> wegen fehlender Urhebernennung<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Gesamtforderung:<\/strong><\/span> 1.140 \u20ac + 260,33 \u20ac Zinsen = 1.400,33 \u20ac<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Nach Aufrechnung<\/strong><\/span> (mit Kostenerstattungsanspruch der Beklagten von 1.240,93 \u20ac): nur noch <span style=\"color: #080060;\"><strong>159,40 \u20ac<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil zeigt, dass unrealistische Preislisten nicht als Grundlage f\u00fcr Schadensersatz dienen k\u00f6nnen &#8211; ma\u00dfgeblich ist die tats\u00e4chliche Marktpraxis.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p
