{"id":8277,"date":"2025-12-28T15:05:11","date_gmt":"2025-12-28T15:05:11","guid":{"rendered":"https:\/\/www.johanna-swist.de\/wpjs\/?p=8277"},"modified":"2025-12-28T15:18:57","modified_gmt":"2025-12-28T15:18:57","slug":"einwilligung-zur-teilnahme-an-doku-soap","status":"publish","type":"post","link":"http:\/\/www.johanna-swist.de\/wpjs\/de\/einwilligung-zur-teilnahme-an-doku-soap\/","title":{"rendered":"Bildrecht: Einwilligung zur Teilnahme an Doku-Soap, Amtsgericht K\u00f6ln, 142 C 227\/12, vom 06.05.2013"},"content":{"rendered":"<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #0d0063;\">Einwilligung zur Teilnahme an Doku-Soap &#8211; Ihre Rechte in den Medien<\/span><\/h1>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Heute stellen wir Ihnen eine Entscheidung des Amtsgericht K\u00f6ln <span style=\"color: #0d0063;\"><strong>(AG K\u00f6ln, 142 C 227\/12, vom 06.05.2013)<\/strong><\/span> vor, die sich mit der Notwendigkeit der Einwilligung zur Teilnahme an Filmaufnahmen besch\u00e4ftigt.\u00a0<\/span><span style=\"color: #000000;\">Gibt es eine Entsch\u00e4digung wegen Pers\u00f6nlichkeitsverletzung bei fehlender Einwillligung zu Filmaufnahmen zu einer Doku-Soap?<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Sachverhalt: Einwilligung zur Teilnahme an Doku-Soap<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Der Kl\u00e4ger (tamilischer Herkunft, eingeschr\u00e4nkte Deutschkenntnisse) hatte seiner Versicherung einen Schaden gemeldet.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Schadenregulierer erschien mit einem TV-Team der Beklagten am Arbeitsplatz des Kl\u00e4gers, um f\u00fcr die Doku-Soap &#8222;Die Versicherungsdetektive&#8220; zu drehen. Der Kl\u00e4ger unterschrieb den vorgelegten Mitwirkungsvertrag nicht, da er ihn aufgrund seiner Sprachkenntnisse nicht verstand und ihn erst von seiner Tochter \u00fcbersetzen lassen wollte. Trotzdem wurden Aufnahmen gemacht und am 17.08.2011 ausgestrahlt.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\">Entscheidung: Einwilligung zur Teilnahme an Doku-Soap<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht verurteilte die Beklagte zur Zahlung von 1.500 \u20ac Schadensersatz (von geforderten 2.000 \u20ac).<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\"><strong>Wesentliche Begr\u00fcndung:<\/strong><\/span><\/p>\n<ul>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><strong>Keine wirksame Einwilligung:<\/strong><\/span> Weder ausdr\u00fccklich noch konkludent lag eine Einwilligung vor.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Der Kl\u00e4ger wurde \u00fcberrascht, er wusste vorher nichts vom TV-Team.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Das Gericht stellte die unzureichende Aufkl\u00e4rung \u00fcber Art, Umfang und Zweck der Ver\u00f6ffentlichung fest.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Die ausdr\u00fcckliche Verweigerung der Vertragsunterzeichnung war als Ablehnung zu werten.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #0d0063;\"><strong>Schwerwiegende Pers\u00f6nlichkeitsrechtsverletzung:<\/strong><\/span>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Drehort war: Intimbereich (Umkleidekabine) ohne Genehmigung des Arbeitgebers.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Darstellung erweckte Eindruck eines Versicherungsbetrugs.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Vollst\u00e4ndige Identifizierbarkeit (Name, Arbeitsplatz)<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Hohe Reichweite durch bekannten Privatsender.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #0d0063;\"><strong>Schweres Verschulden:<\/strong> <\/span>Die Redakteurin setzte sich bewusst \u00fcber fehlende Einwilligung und Sprachbarrieren hinweg!<\/span><\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Urteil betont die Pflicht von Medienunternehmen, vor Dreharbeiten wirksame Einwilligungen
