Sie besch\u00e4ftigt sich mit der Anfertigung von Bildern zu Dokumentation von Verst\u00f6\u00dfen.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Sachverhalt: Fotografieren von Vergehen<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein Beklagter \u00fcberwachte systematisch ein Naturschutzgebiet und fertigte Fotos von Personen an, die seiner Ansicht nach gegen den Landschaftsplan verstie\u00dfen (unangeleingte Hunde, Betreten au\u00dferhalb der Wege). Die Aufnahmen und Notizen leitete er an die Ordnungsbeh\u00f6rde weiter. An einem Tag dokumentierte er 18 Verst\u00f6\u00dfe, in einer Woche \u00fcber 35. Der Kl\u00e4ger, der mit unangeleintem Hund fotografiert wurde, verlangte Unterlassung.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Kernfrage:<\/strong> <\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Darf ein Privatmann Personen im \u00f6ffentlichen Raum fotografieren, um Ordnungswidrigkeiten zu dokumentieren und Beh\u00f6rden zu informieren \u2013 auch wenn er die Fotos nicht selbst verbreitet?<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #0d0063;\">Entscheidung: Fotografieren von Vergehen <\/span><\/h3>\n<p>&nbsp;<\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Gericht verurteilte den Beklagten zur Unterlassung der Fotoaufnahmen.<\/span><\/p>\n<p class=\"whitespace-normal break-words\" style=\"text-align: justify;\"><span style=\"color: #080060;\"><strong>Zentrale Argumentation:<\/strong><\/span><\/p>\n<ul>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Eingriff bereits durch Anfertigung:<\/strong> <\/span>Das Recht am eigenen Bild als Auspr\u00e4gung des allgemeinen Pers\u00f6nlichkeitsrechts (Art. 2 Abs. 1, Art. 1 Abs. 1 GG) ist bereits durch das <span style=\"color: #080060;\"><strong>Anfertigen von Fotos verletzt<\/strong><\/span> \u2013 unabh\u00e4ngig von einer sp\u00e4teren Verbreitung. Der Schutzbereich ist er\u00f6ffnet, selbst wenn keine Ver\u00f6ffentlichungsabsicht besteht.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Interessenabw\u00e4gung:<\/strong><\/span> Bei der gebotenen Einzelfallabw\u00e4gung \u00fcberwiegt das Pers\u00f6nlichkeitsrecht des Kl\u00e4gers gegen\u00fcber der Handlungsfreiheit des Beklagten (Art. 2 Abs. 1 GG):<\/span>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-2.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Zwar ist Naturschutz verfassungsrechtlich anerkannt (Art. 20a GG).<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Aber<\/strong>:<\/span> Es handelt sich nur um <span style=\"color: #080060;\"><strong>Ordnungswidrigkeiten<\/strong>,<\/span> nicht um Straftaten.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Die \u00dcberwachung erfolgte <span style=\"color: #080060;\"><strong>systematisch und heimlich<\/strong><\/span> (18 Verst\u00f6\u00dfe\/Tag, 35\/Woche).<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\">Es geht um <span style=\"color: #080060;\"><strong>Allgemeininteresse<\/strong><\/span>, nicht um Schutz von Individualrechtsg\u00fctern.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Keine Selbstjustiz:<\/strong><\/span> Die Verfolgung von Ordnungswidrigkeiten ist <span style=\"color: #080060;\"><strong>ausschlie\u00dflich Aufgabe der Beh\u00f6rden<\/strong><\/span> (\u00a7 35 OWiG). Dem B\u00fcrger steht keine Selbsthilfe zur Aufrechterhaltung der \u00f6ffentlichen Ordnung zu. Diese Funktion darf er sich nicht anma\u00dfen. Selbsthilferechte (\u00a7\u00a7 227 ff. BGB, \u00a7\u00a7 32, 34 StGB) gelten nur zum Schutz von Individualrechtsg\u00fctern.<\/span><\/li>\n<li class=\"whitespace-normal break-words\"><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Kein berechtigtes Interesse:<\/strong><\/span> Der Beklagte hat andere Mittel (Anzeige als Zeuge). Hier prallen das <span style=\"color: #080060;\"><strong>Recht am eigenen Bild (Teil des allgemeinen Pers\u00f6nlichkeitsrechts)<\/strong><\/span> und das<span style=\"color: #080060;\"><strong> Interesse an der Beweissicherung oder Selbsthilfe<\/strong><\/span> aufeinander.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Grunds\u00e4tzlich gilt in Deutschland: Das ungefragte Fotografieren ist meist unzul\u00e4ssig, aber es gibt Ausnahmen.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\"> Die Grundregel (\u00a7 22 KunstUrhG)<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Bilder d\u00fcrfen grunds\u00e4tzlich <span style=\"color: #080060;\"><strong>nur mit Einwilligung des Abgebildeten<\/strong><\/span> verbreitet oder zur Schau gestellt werden. Bereits das <span style=\"color: #080060;\"><strong>blo\u00dfe Herstellen einer Aufnahme<\/strong><\/span> kann einen Eingriff in das Pers\u00f6nlichkeitsrecht darstellen, wenn daf\u00fcr kein rechtfertigender Grund vorliegt.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h6><span style=\"color: #0d0063;\"> Wann ist es ausnahmsweise erlaubt?<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Fotografieren von Fehlverhalten (z. B. Parkverst\u00f6\u00dfe, Sachbesch\u00e4digung, Beleidigung) kann unter bestimmten Voraussetzungen zul\u00e4ssig sein:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Beweissicherung f\u00fcr ein Verfahren<\/strong>:<\/span> Wenn Sie das Foto ben\u00f6tigen, um eine Straftat oder eine erhebliche Ordnungswidrigkeit anzuzeigen oder zivilrechtliche Anspr\u00fcche (Schadensersatz) durchzusetzen.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Interessenabw\u00e4gung:<\/strong><\/span> Das Gericht pr\u00fcft immer: Ist Ihr Interesse an der Beweissicherung <span style=\"color: #080060;\"><strong>schwerwiegender als das Recht des Betroffenen<\/strong>,<\/span> nicht fotografiert zu werden?<\/span>\n<ul>\n<li><span style=\"color: #000000;\"><em>Beispiel:<\/em> Ein Foto eines Wildpinklers im Stadtpark ist eher unzul\u00e4ssig. Ein Foto von jemandem, der gerade Ihr Auto zerkratzt, ist meist zul\u00e4ssig.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Kein milderes Mittel:<\/strong><\/span> Wenn Sie den Beweis nicht anders erbringen k\u00f6nnen (z. B. durch Zeugen oder Notieren des Kennzeichens).<\/span><\/li>\n<\/ul>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li style=\"list-style-type: none;\"><\/li>\n<\/ol>\n<h6><span style=\"color: #0d0063;\"> Was ist es strikt verboten?<\/span><\/h6>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Selbst wenn ein Fehlverhalten vorliegt, sind folgende Dinge meist illegal und k\u00f6nnen sogar strafbar sein <span style=\"color: #080060;\"><strong>(\u00a7 201a StGB)<\/strong>:<\/span><\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li style=\"list-style-type: none;\">\n<ol style=\"text-align: justify;\" start=\"3\">\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Aufnahmen im gesch\u00fctzten Bereich<\/strong>:<\/span> Das Fotografieren in einer Wohnung, einem umfriedeten Garten oder einer Toilette\/Umkleide ist absolut unzul\u00e4ssig.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Blo\u00dfstellung:<\/strong><\/span> Das Foto darf nicht dazu dienen, die Person im Internet an den Pranger zu stellen (&#8222;Digitaler Pranger&#8220;).<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Verbreitung der Bilder:<\/strong><\/span> Sie d\u00fcrfen das Foto der Polizei oder Ihrem Anwalt zeigen. Sobald Sie es aber auf Social Media, WhatsApp-Gruppen oder anderen \u00f6ffentlichen Plattformen teilen, machen Sie sich strafbar oder schadensersatzpflichtig.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<h6><span style=\"color: #0d0063;\"> Besonderheit: Dashcams und Parkverst\u00f6\u00dfe<\/span><\/h6>\n<p>&nbsp;<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li style=\"list-style-type: none;\">\n<ol style=\"text-align: justify;\" start=\"3\">\n<li style=\"list-style-type: none;\">\n<ol style=\"text-align: justify;\" start=\"4\">\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><span style=\"color: #080060;\"><strong>Dashcams:<\/strong><\/span> Laut BGH d\u00fcrfen Dashcam-Aufnahmen bei Unf\u00e4llen im Prozess verwertet werden, obwohl sie permanent aufzeichnen. Die Kameras sollten jedoch so eingestellt sein, dass sie nur<span style=\"color: #080060;\"><strong> bei einem Unfall (G-Sensor)<\/strong><\/span> dauerhaft speichern.<\/span><\/li>\n<li><span style=\"color: #000000;\">Private <span style=\"color: #080060;\"><strong>&#8222;Kn\u00f6llchen-J\u00e4ger&#8220;<\/strong><\/span>: Das Fotografieren von falsch geparkten Autos inklusive Fahrer zur Anzeige beim Ordnungsamt wurde von Gerichten (z. B.
