{"id":4449,"date":"2018-05-31T09:49:29","date_gmt":"2018-05-31T09:49:29","guid":{"rendered":"http:\/\/www.johanna-swist.de\/wpjs\/?p=4449"},"modified":"2018-06-02T04:08:00","modified_gmt":"2018-06-02T04:08:00","slug":"filmherstellerrecht","status":"publish","type":"post","link":"http:\/\/www.johanna-swist.de\/wpjs\/de\/filmherstellerrecht\/","title":{"rendered":"Filmherstellerrecht"},"content":{"rendered":"<h1 style=\"text-align: center;\"><span style=\"color: #000000;\">Filmhersteller, \u00a7 94 UrhG<\/span><\/h1>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Im \u00a7 94 UrhG sind die Leistungsschutzrechte des Filmherstellers kodifiziert.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Recht besteht unabh\u00e4ngig, von dem Urheberrecht am Filmwerk und unabh\u00e4ngig vom Recht an Laufbildern, \u00a7 95 UrhG.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Schutzgegenstand ist die im Filmmaterial verk\u00f6rperte organisatorisch-wirtschaftlichen Leistung des Filmherstellers.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So gew\u00e4hrt \u00a7 94 UrhG dem Filmhersteller das ausschlie\u00dflich Recht,<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Film zu vervielf\u00e4ltigen,<\/span><\/li>\n<li><span style=\"color: #000000;\">Filme zu verbreiten,<\/span><\/li>\n<li><span style=\"color: #000000;\">Filme \u00f6ffentlich vorzuf\u00fchren oder zu senden,<\/span><\/li>\n<li><span style=\"color: #000000;\">Filme \u00f6ffentlich zug\u00e4nglich zu machen.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Es ist bereits der kleinste Teil eines Films gesch\u00fctzt. In diesem Licht hat der Filmhersteller das Recht, jede K\u00fcrzung oder Entstellung zu untersagen.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Rechtsinhaber ist der Filmhersteller. Das ist derjenige, der tats\u00e4chlich die organisatorische und wirtschaftliche Leistung der Filmherstellung erbringt. Indizien daf\u00fcr stellen folgende T\u00e4tigkeiten:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Auswahl des zu verfilmenden Stoffes und Erwerb der f\u00fcr die Verf\u00fcgung erforderliche Rechte,<\/span><\/li>\n<li><span style=\"color: #000000;\">Auswahl des Drehbuchautors,<\/span><\/li>\n<li><span style=\"color: #000000;\">Auswahl des Mitwirkenden, wie Regisseur, Schauspieler, Kamera, Ton, Licht,<\/span><\/li>\n<li><span style=\"color: #000000;\">Organisation des Films,<\/span><\/li>\n<li><span style=\"color: #000000;\">Finanzierung des Films und Risiko\u00fcbernahme,<\/span><\/li>\n<li><span style=\"color: #000000;\">Vertr\u00e4ge in eigenen Namen.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Es kommt vor, dass das Filmherstellerrecht mehreren gleichzeitig zusteht, wie beispielsweise bei Koproduzenten.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Dar\u00fcber hinaus kommt es zuweilen auch vor, dass der Produzent eines Films wechselt. Dann stellt sich die Frage, welcher von den Filmherstellern Inhaber der Filmherstellerrechte sein soll. Im Ergebnis ist demjenigen das Recht zuzuerkennen, der f\u00fcr die Nullkopie hervorgebracht hat, also den Film erstmals fixiert hat.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ebenso stellt sich die Frage, ob dem Filmproduzenten oder dem Auftraggeber das Filmherstellerrecht bei sogenannten Auftragsproduktion zusteht. Insoweit ist bei Auftragsproduktionen zu unterscheiden. Bei echten Auftragsproduktionen ist der Auftragsnehmer Filmhersteller.
