Aufnahmen von Lichtbildern herzustellen und die Aufnahmen zu vervielf\u00e4ltigen und zu vertreiben,<\/span><\/li>\n<li><span style=\"color: #000000;\">Funksendungen an Stellen, die der \u00d6ffentlichkeit nur gegen Zahlung eines Eintrittsgeldes zug\u00e4nglich sind, \u00f6ffentlich wahrnehmbar zu machen.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Recht der Sendeunternehmen kommt sowohl bei drahtlosen wie auch drahtgebunden Sendungen zum Ansatz. Es ist zu internet-basierten \u00dcbertragungsvorg\u00e4ngen abzugrenzen, wie beispielsweise Webcast oder Video-on-demand.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ebenfalls problematisch erscheint die Beurteilung der Kabelweitersendung. So ist fraglich, ob die Kabelweitersendung eine Weitersendung oder ein integraler Bestandteil des Erstsendevorgangs ist. Dies geht mit der Frage einher, ob eine Verf\u00fcgung \u00fcber Signalschutzrechte angenommen werden muss und ob ein Verg\u00fctungsanspruch gegen\u00fcber den Kabelbetreibern geltend gemacht werden kann.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Im \u00a7 87 Abs. 5 UrhG ist der Kontrahierungszwang zwischen den Sendeunternehmer und der Kabelunternehmen kodifiziert. Dem Vertrag sollen angemessene Bedingungen zugrunde liegen.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Er beinhaltet jedoch nicht die Verpflichtung der Kabelbetreiber zur Weitersendung.
