Die Interpreten, Musiker und Schauspieler kennt man namentlich, der Veranstalter bleibt im Dunkeln. Der Veranstalter, also diejenige, der die organisatorische Leitung \u00fcbernommen hat, ist dem zumeist v\u00f6llig unbekannt. Dabei tr\u00e4gt er das gesamte organisatorische und wirtschaftliche Risiko.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Angesichts dieser f\u00fcr die Pr\u00e4sentation des aus\u00fcbenden K\u00fcnstlers hohen Bedeutung gew\u00e4hrt das Urhebergesetz den Veranstaltern folgende Rechte:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">die Darbietung auf Bild- und Tontr\u00e4ger aufzunehmen, \u00a7\u00a7 77 Abs. 1, 81 UrhG,<\/span><\/li>\n<li><span style=\"color: #000000;\">die Bild- und Tontr\u00e4ger zu vervielf\u00e4ltigen und zu vertreiben,<\/span><\/li>\n<li><span style=\"color: #000000;\">die Darbietungen zug\u00e4nglich zu machen, zu senden und au\u00dferhalb des Raumes, in dem sie stattfinden, wahrnehmbar zu machen, \u00a7 78 Nr. 1 UrhG.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Neben diesen Rechten steht dem Veranstalter das Hausrecht zu. Er kann auch Anspr\u00fcche wegen sittenwidriger Sch\u00e4digung geltend machen. Im Raum stehen auch Anspr\u00fcche wegen Leistungs\u00fcbernahme nach dem Wettbewerbsrecht.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Von hoher praktischer Relevanz ist das Verh\u00e4ltnis des Veranstalters zum aus\u00fcbenden K\u00fcnstler. Zumeist wird dieses Verh\u00e4ltnis umfassend vertraglich geregelt worden sein. Nichtsdestotrotz, liegen hier sehr widerstreitende Interessen vor.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Es wird diskutiert, ob eine Einwilligung des Veranstalters zugunsten des aus\u00fcbenden K\u00fcnstlers zu einer Verwertung als erteilt gilt, wenn der Veranstalter sie nach Treu und Glauben nicht versagen darf.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Dennoch bleiben diese Fragen noch im hohen Ma\u00df kl\u00e4rungsbed\u00fcrftig.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ein weiteres Gebiet, das eigentlich nicht ins Urheberrecht geh\u00f6rt, ist das des Sportveranstalters.
