Daneben verweist \u00a7 57 Markengesetzes und \u00a7 60 Markengesetzes auf die Zivilprozessordnung. \u00a7 64 a Markengesetzes verweist auf das Patentkostengesetz und \u00a7 94 Markengesetzes auf das Verwaltungszustellungsgesetz.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #000000;\">Verfahren vor dem Deutschen Patent- und Markenamt und vor ordentlichen Gerichten<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Deutsche Patent- und Markenamt ist die zust\u00e4ndige Beh\u00f6rde, bei der Marken angemeldet und registriert werden. Wird der Bestand einer Marke angegriffen, so bleibt das Deutsche Patent- und Markenamt zust\u00e4ndig.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">F\u00fcr Verletzungsf\u00e4llt sind indes ordentliche Gerichte zust\u00e4ndig. Im Einzelnen bedeutet das, dass der Markeninhaber vor ordentlichen Gerichten klagt, wenn ein Dritte seine Marke benutzt. Meint er aber, dass ein Kennzeichen unter Missachtung seiner Rechte registriert worden ist, so ist weiterhin das Deutsche Patent- und Markenamt zust\u00e4ndig.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Das Deutsche Patent- und Markenamt erl\u00e4sst seine Verwaltungsakte in Form von Beschl\u00fcssen, \u00a7 61 Abs. 1 Markengesetz.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ist der Adressat mit der Entscheidung des Deutschen Patent- und Markenamtes nicht einverstanden, so kann er den Beschluss durch das Bundespatentgericht \u00fcberpr\u00fcfen lassen.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #000000;\">Parteif\u00e4higkeit und Postulationsf\u00e4higkeit<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Vor dem Deutschen Patent und Markenamt sind sowohl nat\u00fcrliche wie auch juristische Personen parteif\u00e4hig. Auch Ausl\u00e4nder sind in vollem Umfang parteif\u00e4hig. Es besteht an sich auch kein Anwaltszwang.
